Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Telehealth Media website at telehealthmedia.com (the "Site") and the services we provide (the "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or Services.

Services Description

Telehealth Media is a creative agency that produces performance marketing content for telehealth brands. Our Services include video production, creative strategy, and related marketing services for the telehealth industry. Specific service terms, deliverables, and pricing are agreed upon separately in service agreements with clients.

Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any portion of the Site or our systems
  • Interfere with or disrupt the Site or servers connected to the Site
  • Use any automated system to access the Site without our prior written consent
  • Copy, reproduce, or distribute any content from the Site without our permission

Intellectual Property Rights

The Site and its content, including but not limited to text, graphics, logos, images, and software, are owned by Telehealth Media or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, modify, or distribute any content from the Site without our prior written consent.

For creative work produced for clients, intellectual property rights are determined by the specific service agreement between Telehealth Media and the client.

Payment Terms

Payment terms for our Services are established in separate service agreements with clients. These agreements specify pricing, payment schedules, deliverables, and cancellation policies. General terms include:

  • Services are provided on a monthly retainer or project basis as agreed
  • Payment is due according to the schedule specified in the service agreement
  • Late payments may result in service suspension or termination
  • Refunds, if any, are handled according to the specific service agreement

Creator Agreements

Creators who apply to work with Telehealth Media through our creator application process are subject to separate creator agreements that outline compensation, usage rights, production requirements, and other terms specific to content creation services.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELEHEALTH MEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Site or Services
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Site
  • Any bugs, viruses, or other harmful code transmitted through the Site

Indemnification

You agree to indemnify, defend, and hold harmless Telehealth Media and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site or Services, or your violation of these Terms.

Changes to These Terms

Termination
